Presidential Regulation No. 2 of 2021, Apostille Convention, Proof of Foreign Documents

Abstract

This research aims to analyze the legal strength of the Apostille Convention in
proving foreign documents in Indonesia. The Apostille Convention, ratified by the
Indonesian Government through Presidential Regulation No. 2 of 2021, is an international
treaty designed to simplify the legalization process of cross-border public documents.
Prior to the convention, legalizing foreign public documents involved lengthy procedures,
multiple institutions, and high costs, creating administrative obstacles. This study adopts
a normative legal research method by analyzing national and international regulatory
frameworks as well as relevant legal documents. The research findings highlight two main
points. First, the enforcement of the Apostille Convention has had a significant positive
impact, particularly in simplifying and accelerating the legalization process of foreign
documents for recognition in Indonesian courts and other administrative purposes. With
the implementation of online services by the Directorate General of Legal Administration
(Ditjen AHU) since 2022, the process has become more efficient, reduced bureaucratic
barriers, and supported various sectors, including trade, education, and investment.
Additionally, the convention enhances Indonesia's international competitiveness by
facilitating the recognition of public documents among member countries. Second, the
success of the convention's implementation heavily depends on harmonizing national
legal frameworks with the convention's rules, providing adequate digital infrastructure,
and increasing public awareness through socialization. The Apostille Convention not only
simplifies the use of foreign documents for Indonesian citizens but also strengthens
Indonesia’s global cooperation and supports economic growth through more efficient
international relations.
